On January 14, 2022, the Italian Legislative Decree 196/2021 (the ""Italian Decree"") that implements the Single-Use Plastic Directive (""SUPD"") will go into effect. The Italian Decree departs significantly from the SUPD in the following key areas: it offers a more flexible definition of plastic, delays the enforcement of the prohibition on forbidden SUPs, and exempts certain biodegradable and compostable materials from this prohibition. Additionally, the Decree places precise return requirements for used plastic bottles.
